Council to Consider Protections for Protesters and New Public Safety Standards

Yurdin’s ordinance would protect the right to free speech and assembly, enhance public safety

An ordinance sponsored by Councilman Seth Yurdin (Ward One) to protect the public’s right to free speech and assembly will be introduced at tomorrow’s Council meeting.  The ordinance also sets standards for public safety during “First Amendment” assemblies.

 

“Public safety and free expression are not mutually exclusive,” said Yurdin. “This legislation creates clear procedures for protecting our First Amendment rights, and provides that the City protects the safety of our residents.”

 

Typical protests and assemblies (those with 50 or less people and those that do not obstruct public rights of way or sidewalks) would require no action under the Ordinance.  Recognizing the legitimate public safety concerns associated with large assemblies and demonstrations on city streets, sidewalks, and parks, Yurdin explained that organizers of such events would be required to give prior notice to the Police Department and submit a plan to avoid major disruptions. The ordinance also includes clear guidelines for how and when assemblies could be dispersed, and prohibits the City from charging permit fees.

 

“Under these guidelines, the public right to meaningful and robust expression is preserved.  Our right to voice opinions and express our concerns in a public forum remains protected,” said Yurdin.

 

The legislation, if passed, would override the policies established by the City last week which required individuals and groups to file “Protester Registration Forms,” and established “Public Viewing Areas.”

 

“Sadly, there is much evidence to suggest that such regulations can be used an instrument for stifling and discouraging freedom of expression,” Yurdin stated.  “The City of Providence should avoid implementing such measures unless they are clearly justified by the circumstances.” He noted that ultimately, “it is the responsibility of the City not only to protect the public’s right to participate in First Amendment assemblies, but also to encourage the public to do so.”

 

The ordinance, entitled “First Amendment Rights and Police Standards,” is on the docket of the June 18th City Council meeting, which will begin at 7:00 p.m.
